Altplayer Terms of Service

1. Agreement and Eligibility

These Terms of Service ("Terms") govern your access to and use of Altplayer’s products, software, models, APIs, and creator infrastructure (collectively, the "Services"). By creating an account or using the Services, you agree to these Terms.

You may use the Services only if you are legally able to form a binding contract and are of legal age in your jurisdiction to access AI generation tools that may be used to create mature content (typically 18+ or 21+). If you do not meet these requirements, do not use the Services.

2. Provider and Jurisdiction

Altplayer is operated from Singapore. You are responsible for complying with laws that apply to you in your location, including age-restriction, content, and technology-use rules.

3. Nature of the Services

Altplayer provides software, APIs, and infrastructure that generate content based on text and other inputs you provide ("Inputs"), including by using third-party model providers. Altplayer is not a public content-hosting, publishing, or distribution platform. Outputs are returned to the requesting user, and we do not provide a public gallery, public links, or public discovery by default.

You acknowledge that generation is performed on our servers and may require temporary processing and storage to create and deliver Outputs. You remain solely responsible for your Inputs, your use of Outputs, and compliance with applicable laws and third-party rights.

4. Acceptable Use

4.1 Definitions. "Content" means Inputs and Outputs. "CSAM" means any sexual content involving minors or young-appearing persons, including any depiction, request, or sexualization of a minor.

4.2 Prohibited Content and Conduct (Zero Tolerance). You may not use the Services to create, request, generate, depict, distribute, or facilitate:

• CSAM (zero tolerance), sexual exploitation of minors, or any sexual content involving minors or young-appearing persons.
• Any sexual content involving a real person, including "nudify," sexual deepfakes, or sexualized depictions of identifiable individuals (whether or not consent is claimed).
• Pornographic or explicit sexual content (including explicit nudity intended for sexual arousal), incest, bestiality, or sexual violence.
• Graphic violence, gore, or extreme cruelty, or content that celebrates or encourages violence.
• Hate or harassment: content that targets protected groups, dehumanizes, incites hatred, or promotes harassment or doxxing.
• Extremism or terror content, or praise or support for extremist ideologies or groups.
• Illegal wrongdoing: instructions to commit crimes or evade law enforcement; malware, phishing, scams; or other unlawful content.
• Rights violations: infringing intellectual property, privacy, publicity, or other legal rights.

4.3 Evasion and Abuse. You may not attempt to bypass safeguards, filters, rate limits, access controls, or account restrictions; reverse engineer or extract model components; or use automation to overload the Services.

4.4 Enforcement, Monitoring, and Reporting. We may use automated and/or human review to detect and prevent prohibited uses. We may block, refuse, or remove access to Content, and suspend or terminate accounts at any time for policy, legal, safety, or abuse reasons. Where required or appropriate (including suspected CSAM or imminent harm), we may preserve relevant records and cooperate with law enforcement. We are not obligated to monitor Content, and our safety systems may not detect all prohibited uses. You must not rely on the Services to prevent misuse.

5. Accounts and Security

You are responsible for account activity, maintaining password and credential security, and promptly notifying us of unauthorized use. We may suspend or terminate accounts that violate these Terms or create legal, security, or operational risk.

6. Intellectual Property

Altplayer and its licensors retain all rights in the Services, including models, software, interfaces, and underlying technology. These Terms do not grant ownership rights to you.

Subject to your compliance with these Terms, Altplayer grants you a limited, revocable, non-exclusive, non-transferable license to use the Services.

6A. User Content (Inputs/Outputs)

You represent and warrant that you have all rights necessary to submit Inputs and to use Outputs for your intended purpose.

As between you and Altplayer, you retain any rights you may have in your Inputs. Subject to these Terms and third-party rights, you may use Outputs you receive from the Services.

You grant Altplayer a limited license to process Inputs and generate Outputs solely to operate, maintain, secure, and enforce these Terms (including abuse prevention and legal compliance).

7. Third-Party Services

The Services may integrate third-party tools (for example, authentication, payment, or model providers). Your use of third-party services may be subject to their separate terms and policies.

8. Fees and Billing

Certain features may require paid plans, credits, or usage-based billing. Pricing and payment terms are provided at purchase. Except where required by law, fees are non-refundable.

9. Disclaimers

The Services are provided "as is" and "as available" without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, non-infringement, availability, or accuracy.

AI outputs may be incomplete, inaccurate, or inappropriate for your intended use. You must independently review outputs before relying on them.

10. Limitation of Liability

To the fullest extent permitted by law, Altplayer is not liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or loss of profits, data, goodwill, or business opportunities arising from or related to the Services.

Altplayer’s aggregate liability for claims relating to the Services is limited to the greater of (a) the amount you paid Altplayer for the Services in the 12 months preceding the claim, or (b) SGD $100.

11. Indemnification

To the fullest extent permitted by law, you agree to defend, indemnify, and hold harmless Altplayer, its operators, affiliates, licensors, service providers, and each of their directors, officers, employees, contractors, and agents from and against any and all claims, damages, liabilities, losses, penalties, fines, costs, and expenses (including reasonable attorneys’ fees) arising out of or relating to: (a) your Inputs, Outputs, or Content-related activities; (b) your violation of these Terms or applicable law; (c) infringement or alleged infringement of intellectual property, privacy, or publicity rights; or (d) your misuse of the Services.

12. Suspension and Termination

We may suspend or terminate access at any time, with or without notice, including for policy, legal, security, or abuse reasons. Upon termination, rights granted to you end immediately. We may permanently terminate repeat or severe offenders.

13. Changes to Terms

We may update these Terms from time to time. Continued use after updates means you accept the revised Terms.

15. Governing Law and Disputes

These Terms are governed by the laws of Singapore, without regard to conflict-of-law rules. Any dispute arising out of or relating to these Terms or the Services will be brought in the courts of Singapore, and you submit to their exclusive jurisdiction.

16. IP Complaints

If you believe Content generated using the Services infringes your rights, contact us at [email protected] with sufficient information to identify the material and your basis for the complaint. We may investigate and restrict access or terminate repeat infringers.

17. Export Controls and Sanctions

You may not use the Services if you are located in a jurisdiction subject to comprehensive sanctions, or if you are a restricted party under applicable export control or sanctions laws. You may not use the Services in violation of export control or sanctions laws.
